Terms of Use for Commuters/Customers

These Terms of Use (“Terms”) govern your access to and use of the Nomadicpod (“Npod”) mobile application, website, and related services (collectively, the “Platform”).
By using the Platform, you agree to these Terms.
1. About the Platform
Npod is a mobility marketplace connecting users with independent third-party providers for:
- Ride Hailing
- Intercity Transport Booking
- Parcel Delivery
- Car Rentals
- Car Sales Marketplace
Npod is a technology platform and does not directly provide transportation, logistics, or vehicle ownership services unless explicitly stated.
2. Eligibility
You must:
- Be 18 years or older (or legal age in your jurisdiction)
- Provide accurate personal information
- Comply with applicable laws
You are responsible for all activity on your account.
3. Account Security
You agree to:
- Keep login credentials confidential
- Provide accurate information
- Notify us of unauthorized access
We may suspend accounts suspected of fraud or misuse.
4. Ride Hailing Services
- Drivers are independent contractors
- Fares are estimates and may change
- You must behave respectfully and lawfully
- No harassment, violence, or illegal conduct is permitted
Additional fees may apply for:
- Waiting time
- Cleaning/damage
- Toll routes
- Route changes
5. Intercity Bookings
- Schedules are controlled by transport operators
- You must arrive on time
- Valid ID may be required
- Delays and cancellations may occur due to operational conditions
Refunds depend on operator policies.
6. Parcel Delivery
You must NOT send:
- Illegal goods
- Weapons
- Drugs or controlled substances
- Hazardous materials
- Counterfeit goods
You are responsible for packaging and accuracy of details.
Npod is not liable for prohibited shipments.
7. Car Rentals
You agree to:
- Provide valid driver’s license
- Follow rental provider terms
- Return vehicles in agreed condition
You are liable for:
- Traffic violations
- Damage
- Fuel and tolls
- Late returns
- Insurance excess/deductibles
8. Car Sales Marketplace
Npod does not own or verify listed vehicles.
- Buyers must conduct due diligence
- Sellers are responsible for accuracy of listings
- Transactions are strictly between buyer and seller
9. Payments
You authorize payment processing for all transactions.
You acknowledge:
- Prices may vary due to demand and availability
- Taxes and service fees may apply
- Promotions have conditions
Failure to pay may restrict account access.
10. Cancellation & Refunds
Policies vary by service:
- Ride cancellations may incur fees after dispatch
- Intercity refunds depend on operators
- Parcels may be non-refundable after pickup
- Rentals depend on provider agreements
Refunds (if approved) are returned to original payment method.
11. User Conduct
You must NOT:
- Break the law
- Abuse or harass others
- Provide false information
- Commit fraud
- Damage property
- Interfere with platform operations
- Circumvent payment systems
12. Third-Party Providers
Npod connects you to independent providers.
We are not responsible for:
- Provider actions or omissions
- Service delays or failures
- Vehicle conditions
- Driver conduct
13. Safety, Emergency & Community Guidelines
Users must prioritize safety at all times.
- In emergencies, contact local authorities immediately
- Use in-app safety tools where available
- Report incidents via support channels
- Do not engage in unsafe travel behavior
Npod may suspend users involved in safety violations.
14. Dispute Resolution & Arbitration
In the event of disputes:
- Users must first contact Npod support for resolution
- If unresolved, disputes may proceed to mediation or arbitration
- Arbitration shall be binding where permitted by law
- Users waive rights to class action claims where legally enforceable
15. Digital Payments & Wallet (If Applicable)
If Npod introduces wallet functionality:
- Funds may be stored for service use only
- Wallet balances are not bank deposits
- Npod may freeze wallets in cases of fraud investigation
- Withdrawal policies may apply
16. Ratings & Reviews
- Users may rate drivers, providers, and services
- Reviews must be honest and non-defamatory
- Fake or abusive reviews may be removed
- Ratings may affect platform access for providers
17. Force Majeure
Npod is not liable for failure or delay caused by:
- Natural disasters
- Government actions
- Strikes or labor disputes
- Internet or infrastructure failures
- Pandemics or emergencies
- Other events beyond reasonable control
18. Limitation of Liability
To the fullest extent permitted by law:
- Npod is not liable for indirect or consequential losses
- No liability for loss of income, data, or opportunity
- Liability is limited to the amount paid for the affected service
19. Disclaimer
The platform is provided “as is.”
We do not guarantee:
- Continuous availability
- Error-free operation
- Provider performance
- Accuracy of estimated times or prices
20. Privacy
Use of the Platform is governed by the Privacy Policy, which explains data collection and usage practices.
21. Termination
We may suspend or terminate access if:
- Terms are violated
- Fraud or abuse occurs
- Safety risks are identified
- Required by law
22. Changes to Terms
We may update these Terms at any time. Continued use means acceptance of updates.
23. Governing Law
These Terms are governed by the laws of the Federal Republic of Nigeria.
